Trademark in Poland

Sometimes EU trademark protection based on Regulation 2017/1001 is impossible to obtain and you still need to get your logo, sign or slogan protected on Polish territory. I think you will not be disappointed since our country has been in touch with international legal regulations regarding this matter. It should not be very difficult to become familiar with local system of protection of trademarks because it is quite similar and up to date with contemporary world standards. Poland is party to Paris Convention for the Protection of Industrial Property and a member to the Madrid system of international registration of marks. Inter alia it is possible to claim priority or to oppose provisional refusal issued by the Polish Patent Office.

According to Polish law any sign capable of being represented graphically may be considered as trademark, provided that it is capable of distinguishing the goods of one undertaking from those of other undertakings. The most popular examples are words, designs, ornaments, combinations of colours, the three-dimensional shape of goods or of their packaging, as well as melodies or other acoustic signals.

To apply for trademark registration here you may need a representative for at least two reasons: Firstly, the proceedings are in Polish, so it is useful to know local language. Secondly, according to our law, foreign entities generally could be represented solely by Polish trademark attorney (except of EU or EFTA countries as well as Switzerland).
